As of December 2006, an estimated 107,300 Texas employers (37 percent of all
Texas employers) chose the nonsubscription route.  These nonsubscribers
employ approximately 1.77 million Texas employees (23 percent of all Texas
employees).

The first study to estimate the percentage of non-subscribers was conducted in
1993.  In 1993, 44 percent of all Texas employers were nonsubscribers, and
nonsubscribing employers employed 20% of the workforce.  Over the next 13
years, the percentage of employers who have opted out of the Texas workers'
compensation system has declined, but the percentage of employees
employed by nonsubscribers has increased.  This is because today, fewer
small employers (employers of 1-4 employees) are opting out, while more larger
employers (employers of 500 or more employees) are choosing nonsubscription.
